Dear Mr. xxxxxx:

Thank you for your response of October 2, 2001. It is our view that the offer referenced in that response is, in essence, a contractual obligation. The installation of ½ inch additional sub-floor is Richmond American's formulated and proven solution to the "bad batch" of sub-flooring plywood as disclosed by Richmond American during our 14 September meeting. Re-carpeting our home addresses the evident degradation from the repeated removal and re-installation of the carpets and padding, as attempts were made to correct mistakes and repair the sub-floor deficiencies. Re-vinyling is a by-product of repairing the sub-floor deficiencies. Thus, this offer is neither amicable nor fair.

Amicable is our request for the hardwood flooring. It is a modest offset to what we continue to lose in terms of partial occupancy of the home as well as the inconveniences and hardships of constantly moving furniture, packing personal belonging, and becoming home-bound for the duration of the repair attempts. We performed our contractual obligation and settled on the Richmond American designated date, 12 months ago.

It is regrettable that a company, such as Richmond American Homes, on one hand advertises quality and customer satisfaction and on the other turns a blind eye to its customers' hardships inflicted by its deficient material, workmanship, and treatment. Addressing warranty matters is a contractual obligation not a contentious issue. What is contentious is Richmond American's inability or unwillingness to recognize the undue hardships it subjects its customers to.

We expect Richmond American Homes to satisfy our equitable request as well as address the other issues brought to its attention in a timely manner.

For expediency, an advanced copy is being e-mailed to you so that a work plan, action items and schedule, can be formulated. Please e-mail us the finalized action items list and schedule so that we can plan accordingly.
